- Workmanship Warranty: Eastside Plumbing and Gasfitting offers a 10-year workmanship warranty on services provided.
- Access to Site: The customer must grant free and timely access to areas as necessary and allow Eastside employees to operate any required equipment to complete the services.
- Deposits: For quotes we require a 50% upfront deposit before scheduling works.
- Payment Terms: The customer agrees to pay invoices within seven (7) days of receipt, unless alternative payment terms have been previously agreed upon by both parties.
- Extra Work and Charges: Any changes to quotes, including additional requested work, material costs, or labour, will be subject to extra charges. These charges will either be agreed upon as a fixed price or calculated based on time and materials at Eastside Plumbing and Gasfitting’s standard rates.
- Legal Fees: If legal action is required to recover any amount due under this agreement, the customer agrees to cover all court costs and legal fees incurred by Eastside Plumbing and Gasfitting.
- Force Majeure: Eastside Plumbing and Gasfitting will not be liable for any delays, loss, damage, or detention caused by factors beyond our control, such as unavailability of equipment or materials, strikes (including by our employees), civil unrest, government regulations, natural disasters, or any other force majeure events.
- Indemnification: To the fullest extent permitted by law, the customer agrees to indemnify and hold harmless Eastside Plumbing and Gasfitting, its agents, and employees from any claims, damages, losses, or expenses (including legal fees) arising from the performance of the work. This includes claims caused by the customer, their employees, or anyone under their responsibility, even if partially caused by the negligence of Eastside Plumbing and Gasfitting.
- Limitation of Liability: Eastside Plumbing and Gasfitting will not be liable for any indirect, special, or consequential damages, including but not limited to loss of use, profit, increased operating costs, or claims from tenants or clients of the customer.
- Compliance with Laws: This agreement is subject to the rights and remedies provided under the Trade Practices Act and other applicable state and territory laws that cannot be waived by agreement.
- Validity of Fixed Price: The fixed price quotes are valid for 30 days from the date of the proposal. After this period, the price may be subject to revision.
- Jetter & CCTV bookings: Jetter and CCTV services are charged based on the time required to locate the blockage. The hourly rates for these services are provided upfront, and by confirming the booking, the customer agrees to these rates and acknowledges that they will be charged for the actual time spent on the job.
- Leak detection booking: Leak detection services are charged based on the time required to locate the issue. The hourly rates for this service are provided upfront, and by confirming the booking, the customer agrees to these rates and acknowledges that they will be charged for the actual time spent. While we generally allow up to 4 hours for this service, depending on the complexity of the issue, it may take 4-6 hours or more. If the issue can be resolved immediately, we will proceed with the necessary repairs. However, if the situation is more complex, this initial assessment is essential for accurately identifying the leak and providing a detailed quote for any required repairs.
- Time restrictions: Unless the customer has provided written notice of specific time restrictions for the work to be completed, Eastside Plumbing and Gasfitting will perform the necessary work based on the time required to complete the job on the scheduled day. The customer acknowledges that the duration of the work may vary depending on the complexity of the job, and agrees to the charges for the actual time spent on-site. Please note that no further charges will be applied to quoted works unless a variation has been approved by both parties.
